What's new in v1.9: Section 10 (Fees) is replaced with Subscription, Fees & Billing — petboard now offers paid plans (billing begins 1 August 2026), with clauses on auto-renewal / UPI AutoPay, the founder rate lock, cancellation, your data if you lapse, and invoicing. Section 1 (Parties) is updated to name the incorporated entity, PetBoard Technologies Private Limited (CIN U62099KA2026PTC223226), following novation by incorporation. petboard is not yet GST-registered, so invoices are commercial invoices / bills of supply, not tax invoices. (v1.8: petboard no longer stores care photos or videos — see Section 12 and the Data Processing Addendum.)

1. Acceptance of Terms

By creating an operator account on petboard, submitting an intake form, or otherwise using the petboard website at petboard.in (the "Platform"), you ("User", "you") agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, and all applicable laws and regulations of India.

If you do not agree with any part of these Terms, you must not use the Platform. Your continued use of the Platform constitutes ongoing acceptance of these Terms.

These Terms constitute a legally binding agreement between you and petboard ("we", "us", "our", "Company"), governed by the Indian Contract Act, 1872.

Parties, Consideration & Novation

Parties. petboard is operated by PetBoard Technologies Private Limited (CIN U62099KA2026PTC223226), a private limited company incorporated in India, with its registered office in Bangalore, Karnataka ("petboard", "we", "us"). petboard was previously operated as a sole proprietorship; on incorporation (30 June 2026) the benefit and burden of these Terms vested automatically in PetBoard Technologies Private Limited under the novation-by-incorporation provision, without requiring a fresh signature.

Consideration. The mutual consideration for this agreement is: (a) petboard providing you access to the Platform and associated services; and (b) you agreeing to these Terms, providing accurate information, and paying (or committing to pay) any applicable subscription fees.

2. Platform Role & Description

petboard is a SaaS platform that helps pet service operators (boarding facilities, trainers, daycare providers, sitter networks) manage their business operations including intake forms, guest management, photo updates via WhatsApp, and daily activity tracking.

Important: petboard is a business management tool for pet service operators. We do not provide pet care services ourselves. Any arrangement for pet care is made directly between the pet parent and the operator. petboard is not a party to any such arrangement.

Operators on petboard are independent businesses and not employees, agents, or representatives of petboard. petboard does not control the manner, method, or schedule by which Operators perform their services.

Nothing in these Terms creates an employment relationship, partnership, or agency between petboard and any Operator. Operators are solely responsible for their own tax obligations, insurance, licensing, and regulatory compliance.

By registering as an Operator, you agree to:

Animal Welfare: Any Operator found to have mistreated, neglected, or abused any animal will be immediately and permanently removed from the Platform. petboard will cooperate fully with animal welfare authorities and law enforcement in such cases.

This is not an absolute waiver of claims. Your rights under the Consumer Protection Act, 2019, and other applicable Indian laws are not affected by this acknowledgment.

10. Subscription, Fees & Billing

petboard offers paid subscription plans to Operators. During the current beta, use is free; paid billing begins from 1 August 2026. Your plan, price, and billing cycle are shown to you in your dashboard before you commit, and again before any payment is set up.

Plans (per active brand/branch where you operate more than one): Solo ₹199/month, Growth ₹499/month, Pro ₹999/month. Annual billing is available at ten months' price for twelve months (Solo ₹1,999, Growth ₹4,999, Pro ₹9,999 per year). Enterprise plans are arranged directly with you.

Nothing is charged to you without an affirmative action by you. Reserving or "locking" a rate is a commitment to a price — it is not a payment and it does not authorise any charge or auto-debit. Payment is set up separately, later, and only with your explicit approval at that time.

10A. Auto-renewal & UPI AutoPay / e-mandate (monthly plans)

If you choose a monthly plan, you set up an auto-renewing payment instruction (UPI AutoPay or card e-mandate) through our payment partner, Razorpay. Before you approve it, we show you: the exact amount, the billing cycle, and the date of the first debit. Each renewal then debits automatically until you cancel.

Trial to paid: new Operators start on a card-less free trial. No payment instruction is set up during the trial. You are only asked to set up payment if and when you affirmatively convert to a paid plan at trial end — the amount and cycle are shown to you before you approve.

10B. Service availability & support

We aim to keep petboard available and to respond to support requests promptly (our target is a response within two business days via the channels published in your dashboard). This is a good-faith aim, not a guaranteed service level. The Platform is provided on an "as is" and "as available" basis (see Section 11), and we do not offer uptime guarantees or service credits. We may perform maintenance and will give reasonable notice of planned downtime where practical.

10C. Founder rate lock

If you are one of our first 50 Operators ("founder Operators"), your founder rate is locked for as long as you maintain a continuous paid subscription, including if you change plans (for example, Solo to Growth continues at the founder Growth rate, not a future public rate).

For Operators who are not founder Operators, we will give you at least 30 days' notice before any change to your subscription price. Existing paid functionality will not be removed without notice.

10D. Cancellation

You may cancel a paid subscription at any time, self-service, from your dashboard — no email, no phone call, and no retention hurdle beyond a single optional offer. For monthly plans, cancellation stops future auto-debits and you keep access until the end of the paid period. For annual plans, access continues to the end of the paid year (annual payments are not refunded mid-term). We will tell you clearly, before you confirm, what changes on cancellation — including that access to imported rosters and history becomes read-only (see 10E).

10E. Your data if you lapse or cancel

We do not delete your data when you stop paying. If a subscription lapses or is cancelled, your account moves to read-only with "Export Everything" available so you can download your records at any time. We hold your account in this state for a grace period and thereafter handle the personal data of your pet parents in line with the retention and deletion terms of the Data Processing Addendum and applicable law. You can request export or deletion at any time.

10F. Invoices & GST

PetBoard Technologies Private Limited is not currently registered under GST (we will register once we cross the applicable turnover threshold). Until then, the amount you pay is the full amount due: no GST is added, and the document you receive is a commercial invoice / bill of supply — not a tax invoice, and it does not carry input tax credit. Once we are GST-registered, we will issue tax invoices with GST, and you will be able to claim input tax credit against them where eligible.

11. Limitation of Liability

To the maximum extent permitted by applicable Indian law:

Nothing in these Terms shall be construed to exclude or limit petboard's liability for: (a) fraud or willful misconduct; (b) death or personal injury caused by petboard's negligence; (c) any liability that cannot be lawfully excluded under the Consumer Protection Act, 2019, or other mandatory Indian law.

You agree to indemnify, defend, and hold petboard, its directors, officers, employees, and agents harmless from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal data in compliance with the Digital Personal Data Protection Act, 2023, and applicable Indian data protection laws.

By using the Platform, you consent to the collection and processing of your data as described in the Privacy Policy.

Data Processing Addendum

These Terms are supplemented by the Data Processing Addendum (DPA), which governs how petboard processes personal data of your pet parents when you use the Platform to manage your business operations. Under the DPA:

We will acknowledge your grievance within 48 hours and resolve it within 30 days of receipt.

If you are not satisfied with the resolution, you may escalate to the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019.

18. Dispute Resolution & Governing Law

Governing Law

These Terms are governed by and construed in accordance with the laws of India.

Jurisdiction

Any disputes arising under these Terms shall be subject to the jurisdiction of courts in Bangalore, Karnataka, India.

Consumer Forum Rights Preserved: Nothing in these Terms restricts your right to approach Consumer Disputes Redressal Commissions under the Consumer Protection Act, 2019. Your statutory rights are fully preserved.

19. Force Majeure

petboard shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to: natural disasters, pandemics, government actions, internet or telecommunications failures, or third-party service provider failures.
